This document (the "Agreement" or "User Agreement") along with the privacy policy and the disclaimer details the entire set of terms and conditions applicable to your use of the website www.GhanaAuction.com. You understand and unconditionally accept that your use of this site is contingent upon your acceptance of this document in its entirety. In case you signify your acceptance of the fees which are shown at the time of listing, the same shall constitute a legal and binding contract and you shall be liable to pay the amounts mentioned therein, and on the terms which are shown to you at the time. The fees and the terms which shall be applicable and which will be shown to you at the time of listing of the auction shall be deemed to be a part of this agreement, by reference.

The operators of this website may offer promotional offers from time to time, and / or may withdraw any particular or all the promotional offers at their sole discretion. Any enhanced or reduced fees applicable for such special offer shall be applicable for the duration of that offer only.

In the event the operators of this website introduce a new product or service on this website, the fee for such product or services shall be notified separately and shall become a part of this document by reference. Unless otherwise stated, all fees are quoted in Ghanaian Cedis. You are responsible for paying all applicable taxes.

Your use of this website signifies your understanding that www.GhanaAuction.com is not an Auctioneer. Nor does it conduct auctions on its own. This website and the operators are acting as facilitators for bringing together sellers and buyers only. Apart from charging a fee for bringing buyers and sellers together, the operators of this website are neither interested in the products or services which are being sold or purchased. The sales may take place on a fixed price format or a bidding price format. The operators of this website are not involved in the actual transaction between buyers and sellers, unless where such service is subscribed.

Your use of this website also signifies your understanding and acceptance that the operators of this website have no control over the quality, safety or legality of the items advertised, nor the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to pay for items. The website operators cannot ensure that a buyer or seller will actually complete a transaction. Consequently, we do not transfer legal ownership of items from the seller to the buyer, and nothing in this agreement shall modify the governing provisions, under which legal ownership of an item is transferred upon physical delivery of the item to the buyer by the seller.

This website also offer you a reverse auction area called i-Want where buyers can post requests for items that they want and sellers can bid on those items. Since multiple sellers may actively compete with each other for items there is a possibility of getting the item at a low price. GhanaAuction.com does not however guarantee that you will get items at a low or lower price for any or all reverse auctions.

The operators of this website shall make every reasonable effort to verify the identity of the users of this website. If you are unable to provide your identity to the satisfaction of the website operators, your access to this site may be curtailed, restricted or terminated. At the same time however, given the impersonal and remote nature of the internet, it may not be possible for us to authoritatively verify all the credentials presented to us. We therefore are unable to assure you about the real identity of the users of this website. Please do not rely on any credentials listed or held out, any information that is made available in any form without independent verification. You agree not to hold the operators of this website liable for any loss, damage or hurt that may be caused to you by another user of this website, in any manner or for any reason.

In the event that you have a dispute with one or more users, you release GhanaAuction.com (and its officers, directors, agents, subsidiaries, joint ventures and employees) from all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes without exception.

Please note that there are inherent risks of financial transactions electronically and especially over the internet. Additionally, there may also be risks dealing with international trade and foreign nationals. By using this Site, you agree to assume the sole responsibility for any and all such risks and to absolve GhanaAuction.com for all the acts or omissions of users on the Site.

As a buyer on this website, your bids are legally binding contracts between you and the seller and you agree to abide by it. In case you are the successful high bidder on an auction or if you elect to purchase a fixed price format item, and you must pay the seller the agreed amount and on such terms as indicated at the time of your bid.

You agree to be bound by the conditions of sale included in the item's description so long as those conditions of sale are not in violation of this Agreement or are held unlawful by a court of competent jurisdiction.

You may not withdraw a bid once it has been placed on this website unless you can establish a typographical error.

If you choose to bid on any item that is prohibited by law to be sold to a minor person, you are certifying that you are a major and that you have the legal right to purchase such items.

In case you place an item for sale on this website, using any of the sale formats made available, you are solely responsible for the accuracy and authenticity of the description of that item. You must describe it in an appropriate manner, and where any law so prescribes, in accordance with such statutory provisions. Your listings may only include text descriptions, graphics, pictures and other content relevant to the sale of that item. You may not violate the intellectual property of any person. By submitting a listing, you assume all responsibility for it and agree to all consequences that may flow from any claim of copyright, trademark, patent or other violation. All listed items must be listed in an appropriate category. All items in multiple item listings must be identical.

In case you opt for GhanaAuction's Proxy Buyer program, GhanaAuction will have the item for which you are bidding, have purchased or intend purchasing inspected physically on location by its staff. You will be provided an objective report about the item and its conditions including photographs if possible. GhanaAuction warrants and guarantees that the report it provides you under this scheme shall be true and accurate as of the moment of such inspection. GhanaAuction can not however guarantee that the report shall remain accurate or binding even later since the particular item is outside the physical control of GhanaAuction.

You are legally and contractually bound to sell items for which a buyer has made the highest bid (subject to the reserve price expressly mentioned) or which has been agreed to be purchased at a fixed price. You are obligated as the seller to complete the transaction with the seller. Your obligation to sell may not be violated unless the buyer has failed to make the payment as agreed upon or in case of any fraud etc. or where prohibited by any law for the time being in force.

Without prejudice to its rights or remedies, GhanaAuction.com may immediately suspend or terminate your account and / or access to this website if we suspect that you (by conviction, settlement, insurance or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with this website or any product or service available here.

We do not endorse or approve or disapprove any of the advice, content, profiles, information etc. provided by third parties on the website. Your viewing or other use of the end content is strictly a matter between you and the producers / authors of such content.

We shall make best efforts to ensure that in case of any failed transaction, any money if debited from your account, and if it warrants a refund, is refunded within 14 days.

We shall make every reasonable effort to ensure the safety and continued availability of the website and / or content including third-party content. However in case of any downtime, failure or deletion of the website or any content, you agree to hold us free of all liability and blame.
